NYFW Competition

1. Promoter

This promotion (the “Competition”) is offered by Connect USA LLC dba Mr Smith Products, 1330 Post & Paddock, Ste. 400, Grand Prairie, TX 75050, United States (“Promoter,” “we,” “us”). For questions, contact yes@mr-smith.com.au.

2. Promotion Period

Entries open at 12:00 a.m. ET on 26th August 2026 and closes at 11:59 p.m. ET on 31 December 2026 (the “Entry Period”).

3. Eligibility

Open to individual, professional hairstylists located in and licensed to operate in the United States, and who are the age of majority in their state of residence (18, except 19 in Alabama and Nebraska, and 21 in Mississippi) or older at the time of entry. Each participating salon may have multiple eligible stylists enter individually. Employees, contractors, and immediate family members (spouse, parent, child, or sibling, and each of their spouses) of Promoter, and its promotional agencies are not eligible to win the prize described in Clause 6, but remain eligible for the Stylist Reward described in Clause 9. This Competition is void where prohibited by law.

4. How to Enter

To enter, a hairdressing stylist must, during the Entry Period:

• Feature The Foundation 200mL, and any relevant additional Mr. Smith styling products as part of the finished transformation;
• Post an original video publicly on Instagram, TikTok, or both, heroing The Foundation hair transformation (an Instagram Reel or a TikTok video);
• Tag and follow @mrsmithhair on the platform used;
• Tag their salon's official account on that same platform; and
• Include the official campaign hashtag #MrSmithTheFoundationNYFW

Multiple entries are permitted. Each entry must independently satisfy all requirements above and must remain public and unaltered, on its original platform, through the end of the judging period described in Clause 7. No purchase or fee is required to enter, and a purchase will not increase an entrant's chances of winning.

5. Eligible Platforms and Cross-Posting

Entries may be submitted on Instagram, TikTok, or both. Judging is platform-agnostic, an entry posted on TikTok is assessed on the same criteria as one posted on Instagram. If a stylist posts the same video to both platforms under the campaign hashtag, it will be treated as a single entry for judging and Stylist Reward purposes, not as two separate entries. For one stylist to enter multiple videos into the competition, they need to be substantially different from each other. 

6. The Prize

One winning stylist and one guest of their choosing will receive: round-trip economy flights to New York City; hotel accommodation for two (2) nights for two (2) guests in a shared room; two (2) tickets to a New York Fashion Week show (selected at Promoter's sole discretion and subject to availability); and USD $500 spending money. Approximate total retail value: USD $3,500. The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash, in whole or in part. If any element of the prize is unavailable, the Promoter reserves the right to substitute an item of equal or greater value. Travel is expected to take place during New York Fashion Week in February 2027; exact dates, the specific show, and accommodation are subject to availability.

7. Judging

The winner will be selected by an internal Mr. Smith Haircare judging panel from all eligible entries received on Instagram and/or TikTok during the Entry Period, and will be based on the following weighted criteria:

• Creativity & Originality of the final transformation achieved (40%)
• Product Representation: Authentic, Visible use of The Foundation (30%)
• Technical Execution & Video or Reel Production Quality (30%)

Winner selection is based solely on these criteria; no random element is used at any stage, including in the event of a tie. In the event of a tie, the two pieces of content will have to be re-scored, with the inclusion of two additional judges. 

8. Winner Notification

The winner will be contacted on the 11th January 2027 via direct message on the platform (Instagram or TikTok) their winning entry was posted to, from Mr. Smith Haircare's official account on that platform, using the contact tagged in the entry. If the winner does not respond within 48 hours of private notification, Promoter will select an alternate winner from the remaining eligible entries using the same process, until the winner is confirmed. Once confirmed, the winner will be announced publicly via Mr. Smith Haircare's official Instagram and TikTok accounts.

9. Stylist Reward

Each individual stylist (identified by their unique Instagram or TikTok handle) who submits at least one eligible entry under Clause 4 will receive one (1) complimentary Mr. Smith The Foundation 200mL, regardless of how many eligible entries, or on how many platforms, that stylist submits (subject to the single-entry rule in Clause 5 for cross-posted content). This reward is available while stocks last and is separate from, and in addition to, eligibility for the prize in Clause 6.

The Foundation 200mL will be delivered to the eligible stylist monthly, by the relevant stylist’s or salon’s Business Consultant during their next in-person visit to the said salon. Alternatively, a complimentary coupon code will be shared directly with the creator via social DM, the coupon will allow the creator to order The Foundation on the Mr. Smith Website (mr-smith.com.au). The individual coupon code will be inclusive of complimentary shipping applicable to this order.

10. Content Ownership

By entering you confirm that the video was created by you, is original, that you haven't reappropriated anyone else's work, and that you comply with Instagram and TikTok’s rules. You also give The Promoter permission (a non-exclusive, royalty-free, worldwide license) to use, repost, and adapt your video, along with your name and salon name, across the Mr. Smith marketing channels, for 24 months.

11. Disqualification

Promoter reserves the right, at its sole discretion, to disqualify any entry or entrant that violates these Terms, contains inappropriate or infringing content, or is submitted using fraudulent, misleading, or automated or AI-assisted means, and to revoke a prize awarded in error, including after the fact.

12. Taxes

The winner is solely responsible for any applicable federal, state, and local taxes arising from receipt of the prize. Because the prize's approximate value (USD $3,500) exceeds the IRS reporting threshold, Promoter will issue an IRS Form 1099-MISC to the winner where required by law and may request a completed Form W-9 prior to prize fulfillment. Failure to provide required tax documentation within 48h of request, may result in forfeiture of the prize.

13. Limitation of Liability

To the maximum extent permitted by law, Promoter, its parent, affiliates, and agencies are not responsible for any injury, loss, or damage of any kind arising from entry into this Competition or from acceptance, use, or misuse of the prize, including travel, and including any technical failure, outage, or change in the functionality of Instagram or TikTok. Entrants participate at their own risk.

14. Your Privacy

Personal information collected in connection with this Competition will be used in accordance with Mr. Smith Haircare's Privacy Policy, including to administer the Competition, contact entrants, and fulfill the prize.

15. Platform Disclaimer

This Competition is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta Platforms, Inc., TikTok Inc., or ByteDance Ltd. Any questions, comments, or complaints regarding this Competition must be directed to the Promoter, not to Instagram, Meta, TikTok, or ByteDance.

16. Force Majeure

At times, circumstances beyond the reasonable control of Mr. Smith (including, but not limited to, strikes, floods, fires and extreme weather events, computer malfunctions, failure of service providers to perform services or injury or illness of key personnel) may affect Mr. Smith’s ability to carry out its obligations to you.  Should this occur, you release the Promoter from any obligation to dispatch your order while those circumstances continue.  Whilst the force majeure circumstances continue, Mr. Smith may choose to cancel your order, or otherwise to complete your order once the force majeure event has come to an end.  If a major delay is anticipated, Mr. Smith will contact you to discuss alternative arrangements.

17. General Conditions

Promoter reserves the right to cancel, suspend, or amend this Competition at any time without liability, subject to applicable law. 

This Competition is governed by the laws of the State of Texas, United States of America, without regard to its conflict of law principles.
